Implementation of GI system in Ukraine

As part of Ukraine’s fulfillment of its obligations under the Association Agreement with the EU, it is envisaged to harmonize Ukrainian legislation with European and provide adequate legal protection for European geographical indications in order to obtain similar protection for Ukrainian geographical indications on the EU market.

The Ministry of Agrarian Policy and Food of Ukraine is authorized to determine and control the special properties, qualities and other characteristics of agricultural products in accordance with the order of the Cabinet of Ministers of Ukraine dated April 23, 2001, No. 149.

The effective Law of Ukraine «On the Protection of Rights to Indicate the Origin of Goods» does not fully ensure compliance of the regulation with EU legislation. Therefore, a draft amendments to it was submitted to the Verkhovna Rada of Ukraine, which, in particular, are aimed at introduction of regulatory principles in this area on the basis of EU acts. Also, the Ministry with the assistance of the European experts is developing the draft laws on the agricultural and food products, spirit drinks and wine. Thus, this will regulate the quality of agricultural products and food products, definition, description, presentation, labeling and protection of geographical indications of alcoholic beverages and flavored wine products.

These changes in the legislation should provide for the introduction in Ukraine of a category apparatus equivalent to a European one with regard to determining the spirit beverages, requirements for the quality of agricultural and food products. Consequently, formal barriers to accessing the European market for Ukrainian products using existing trade preferences will be removed. In addition, Ukrainian goods will automatically move to the level of higher-quality and more expensive goods, since in order to use geographical indications on goods, strict observance of a certain production scheme, careful selection of raw materials, and quality control at all stages of production is needed.

These steps are implemented jointly with the EU Project: «Support to the Development of Geographical Indications System», which was launched in September 2017. One of the major tasks of the Project is to assist Ukrainian producers in creating and registering geographical indications of wines, spirit beverages and agricultural products.
