The state of European integration in the field of agriculture and SPS

Background

In order to promote the development of domestic agriculture through approximation of legislation and national regulation in accordance with the norms and standards of the European Union, chapter 17 «Agriculture and rural development» is included in Section V «Economic and sectoral cooperation» of the Association Agreement, which provides an opportunity for Ukraine, in accordance with the provisions of Annex XXXVIII, to consider the provisions of the EU regulations as part of legal standards with the gradual approximation of the domestic legislation in a particular area of agriculture to the EU standards.

The Agreement and the relevant Annex do not envisage clearly defined timelines for its implementation in this respect, providing the possibility of gradual approximation of the domestic legal regulation of the agricultural sector within the timeframes acceptable for Ukraine.

At the same time, implementation of the Association Agreement, in particular articles 403 – 406, promotes Ukraine's cooperation with the EU regarding mutual understanding of agricultural policy and development policies of agrarian regions; development of modern and sustainable agricultural production, promotion of organic production methods and biotechnologies through introduction of best practices in these areas, sharing knowledge and best practices to promote the economic well-being of rural communities and increase the competitiveness of the agricultural sector, efficiency and transparency of markets, investment climate, and standardization of the requirements for the quality of domestic products.

For this purpose, the Government of Ukraine approved a plan of actions to implement the Association Agreement (Resolution of the Cabinet of Ministers of Ukraine dated October 25, 2016, No. 1106), which will ensure continuity of fulfilment of Ukraine's obligations. The specified Plan of Actions establishes clear deadlines and responsibility of the governmental institutions for carrying out specific tasks associated with implementation of the Association Agreement.

In general, the action plan is a large document that consists of 1,199 pages. It formulates 1943 tasks covering 27 areas. 106 governmental authorities of Ukraine are responsible for carrying out tasks. Each of these tasks corresponds to a separate article of the Agreement or implements certain rules of law (acquis) of the European Union.

Among the authorities responsible for the direction «agriculture» are Ministry of Agrarian Policy and Food of Ukraine, State Service for Food Safety and Consumer Protection, Ministry of Economic Development, Ministry of Foreign Affairs, State Fishery Agency, Ministry of Justice, Ministry of Environment, Ministry of Health, Ministry of Finance, SFSU, State Forest Agency.

It is important that the Ministry of Agrarian Policy and Food of Ukraine and the State Service for Food Safety and Consumer Protection are most involved in implementation of the commitments, since an important area of cooperation under the Association Agreement is the adaptation of SPS legislation.

Of all the tasks that are defined by the Cabinet of Ministers of Ukraine dated 25.10.2017 №1106 pursuant to the Association Agreement, Ukraine’s commitments in the agricultural sector represent 28%. One of the largest is the sphere of sanitary and phytosanitary measures.

Therefore, in order to implement Chapter IV of Section IV «Trade and Trade-related Issues» of the Association Agreement (Article 64), the Government approved a comprehensive strategy for the Implementation of the legislation on sanitary and phytosanitary measures. The document defines a schedule of systematic legal and regulatory approximation of domestic legislation in the field of sanitary and phytosanitary measures to the legislation of the European Union.

The aforementioned strategy will be reflected in Annex V of the EU-Ukraine Association Agreement, after the approval of the relevant decision by the SPS Management Subcommittee.

According to the integrated strategy of implementing  SPS legislation, by the end of 2021 Ukraine should adapt more than 250 EU acts to the national legislation in such areas as state control in SPS sphere, food and feed safety, animal health and welfare, plant health, etc.

Starting in 2014, after signing of the Association Agreement, which entered in full into force on 1 September 2017, Ukraine launched a large-scale process of implementing measures to adapt the legislation to the norms of the EU law, including in the field of agriculture.

In 2014-2015, the Ministry of Agrarian Policy has concentrated its legislative initiatives in the field of deregulation and food safety.

In 2016-2017, the focus was on adaptation of the legislation on state control in the sphere of SPS, continued work on implementation of food safety requirements, and so on.

In particular, at the legislative level, it was planned to introduce in Ukraine a European model of a system for ensuring the safety and quality of food products, based on HACCP procedures. On September 20, 2015, the Law of Ukraine «On basic principles and requirements for safety and quality of food products» came into force. This law provides for the introduction in Ukraine of a European model of a system for ensuring the safety and quality of food products, based on procedures of HACCP principles. Also, on December 21, 2017, the Law of Ukraine «On safety and hygiene of feeds» was adopted, according to which, the requirements for the implementation of the HACCP system apply to feed market operators engaged in production, circulation and use of feeds, effective from January 2020.

Furthermore, on June 30, 2016, the Law of Ukraine as of December 8, 2015 No. 864-VIII «On introduction of changes to certain Laws of Ukraine concerning bringing the Ukrainian legislation on Seed Production in line with European and International norms and standards» came into force and changes were made to the laws of Ukraine «On seeds and planting material», «On the protection of plant varieties rights».

In order to implement this law, 9 resolutions of the Cabinet of Ministers of Ukraine and 6 acts of the Ministry of Agrarian Policy were adopted which regulate the issues related to keeping the registers in the field of seeding, import of seeds to Ukraine, issuance of certificates to agronomist inspectors and the procedure for certification and marking of seeds and planting materials.   

04.04.2018, the Law of Ukraine «On State Control over the observance of legislation on Food, Feed, Animal By-Products, Animal Health and Welfare» dated 05/18/2017 No. 2042-VIII came into force.

This Law defines the legal and organizational basis of state control exercised to verify that market operators comply with food laws, feed, animal health and welfare, as well as legislation on animal by-products when importing (shipping) such products to the customs territory of Ukraine.

The adoption of this Law provides for several changes, among which is the introduction of risk-based control with a certain frequency.

That is, the risk assessment for the market operator takes into account the type of product with which the economic entity works, assesses the type of activity production or just transportation and takes into account the results of previous inspections – or whether the comments on the activities of the enterprise were recorded, how serious they were. Further, the rating system assesses the degree of risk and depending on it, the frequency of scheduled inspections is determined from once per quarter to once every three years.

In 2018, the main tasks should include:

  • Legislative support for functioning of the organic market;
  • legislative support for the functioning of the feed market;
  • Harmonization with the EU legislation of requirements for items in contact with food products;
  • Bringing the requirements for consumer information on food in line with EU legislation;
  • Bringing the requirements for the production and circulation of coffee and chicory, fruit raw materials for the production of juices and honey in accordance with the EU legislation.

Thus, during 2017–2018, a number of important legislation in the field of organic production, state control, safety and feed hygiene, consumer information on food products were adopted, and a number of other important standards were developed, in particular: the draft law on requirements for items and materials in contact with food; on tracking and labeling the genetically modified organisms and others.

According to the «Pulse Agreement», in 2018, the percentage of the tasks accomplished in the «Agriculture» section is 86%, and the SPS section» 64% (at the same time a significant increase in the level of implementation is expected due to the completion of registration in the Ministry of Justice of a number of already developed documents in the first quarter 2019 approximately 25-30%).

I. Agriculture

In 2018, the Ministry of Agrarian Policy implements 158 measures in the framework of realization of the tasks of the Government related to implementation of the Association Agreement between Ukraine and the EU.

DIRECTION «ORGANIC FARMING»

Completed:

The Law of Ukraine «On the basic principles and requirements for organic production, circulation and labeling of organic products», signed by the President of Ukraine on 30.07.2018, was adopted.

The specified Law of Ukraine introduces a clear and transparent system of registration of certification bodies, market operators and organic seeds, determines the mechanism of state control (supervision) over the activities of the market participants of organic products and establishes their responsibility for violating legislation in this area. At the same time, procedures for certification of organic production and the circulation of organic products are regulated, and the requirements for certification bodies and their functions are established.

Currently, work on development of the bylaws is in progress.

DIRECTION «STANDARDS OF TRADE IN PLANTS»

Standards for trade in plants relates to the harmonization of current legislation with EU requirements in the field of trade in plants, as well as in seeds of plants, products derived from plants, fruits and vegetables.

Done: 

Seeds and seedlings

Verkhovna Rada of Ukraine adopted the Law of Ukraine of December 8, 2015 No. 864-VIII «On amendments to certain laws of Ukraine on bringing Ukrainian legislation on seeds and seedlings into compliance with European and International norms and standards», which entered into force on June 30, 2016.

Respectively, the changes were introduced to the Laws of Ukraine: 

  • On seeds and seedlings;
  • Protection of plant variety rights (PVR).

Also, in order to implement this law, the Ministry of Agrarian Policy has developed and adopted 9 resolutions of the Cabinet of Ministers of Ukraine and 6 acts of the Ministry of Agrarian Policy.

These acts regulate the issues of keeping registers in the field of seed, importing seeds to Ukraine, issuing certificates to agronomist inspectors and the procedure for certification, marking of seeds, and planting materials.

Cocoa and chocolate products

In order to introduce a mechanism for the gradual transition of domestic producers to the new requirements of production, labeling of cocoa and chocolate products, the Ministry of Agrarian Policy of Ukraine adopted an Order dated 28.12.2017, No. 705 «On amendments to the order of the Ministry of Agrarian Policy and Food of Ukraine dated April 13, 2016 No. 157» (registered in the Ministry of Justice of Ukraine on January 4, 2018, No. 17/31469).

The order is aimed at minimizing the financial losses of business entities associated with the transition to new production conditions.

Sugar

In order to bring the legislation in line with the requirements for certain types of sugar intended for consumption, Ministry of Agrarian Policy of Ukraine adopted Order dated 02.11.2017 No. 592 «Requirements for types of sugars intended for human consumption» (registered in the Ministry of Justice of Ukraine on November 27, 2017, Reg No. 1434/31302).

Developed: 

Juices, coffee extracts and chicory

For the implementation of EU directives concerning juices, coffee extracts and chicory extracts (the direction «Standards for trade in plant»), draft regulatory acts of the Ministry of Agrarian Policy have been developed which are currently under approval by the interested CEBs.

DIRECTION «QUALITY POLICY»

The direction of the «Quality Policy» is aimed at bringing the norms of the current legislation in line with the EU requirements in the field of protection of geographical indications.

Done: 

A draft law «On amendments to certain legislative acts of Ukraine on Improving the legal protection of geographical indications» (registration No. 6023 dated 03.02.2017) was developed.

After a lengthy process of agreeing the text and its consideration in the Committees of the Verkhovna Rada of Ukraine in order to bring it in line with EU law, on 13.03.2018, a draft law No. 6023 was adopted in the first reading.

According to the text of the draft law No. 6023, important changes are foreseen that allow the development of special bills on agricultural products, spirits and wines.

The process of development of draft laws is in progress, which should regulate the specifics of the procedures of geographical indications for:

  • agricultural and food products;
  • spirits;
  • wines.

When developing the draft law on agricultural products, such an important quality scheme for the Ukrainian market is introduced as traditional guaranteed features (traditional dishes).  

II. Sanitary and phytosanitary measures

Information on the status of implementation of SPS legislation

In pursuance of Ukraine's obligations under the Association Agreement, a number of important laws in the field of SPS were adopted, namely:

  • Law of Ukraine No. 771/97-BP «On the basic principles and requirements for safety and quality of food products» (new edition dated  20.09. 2015 with amendments dated 04.04.2018);
  • Law of Ukraine No. 287-VIII «On by-products of animal origin not intended for human consumption» (adopted on April 7, 2015, amended on October 19, 2016, effective date: May 09, 2016);
  • Law of Ukraine No. 2042-VIII «On state control over observance of legislation on food, feed, by-products of animal origin, animal health and welfare» (adopted on 05/18/2017, effective date 04.04.2018);
  • Law of Ukraine No. 2264-VIII «On safety and hygiene of feed» (adopted on December 21, 2017, effective date January 19, 2020).

In pursuance of the above laws, a number of by-laws are envisaged, some of which have already been adopted, and some are being developed.

In addition, a draft Law of Ukraine «On Amendments to the Law of Ukraine «On Veterinary Medicine» was developed, which was made public and is under discussion with the public.

This draft law should, first of all, regulate legal relations in matters of animal health and welfare, private veterinary practice, circulation of veterinary drugs, etc.

  7. The order of the Ministry of Agrarian Policy of Ukraine dated March 16, 2018 No. 141 «On Approval of the procedure for granting the status of an official veterinarian, an authorized veterinarian, a slaughterhouse employee authorized to perform the duties of an Assistant to the State Veterinary Inspector, and perform their activities» was approved and registered with the Ministry of Justice of Ukraine as of 27.03. 2018 No. 368/31820.
  8. The order of the Ministry of Agrarian Policy dated 25.06.2018 No. 289 «On approval of sampling methods and sample preparation for determining the maximum residue levels (MRL) of pesticide in products of plant and animal origin for the purposes of state control» was approvedand registered with the Ministry of Justice of Ukraine dated July 23, 2018, reg. No. 857/32309.
  9. A draft order of the Ministry of Agrarian Policy «On Approval of requirements for the Import (shipment) of live animals to Ukraine, their reproductive material, food products of animal origin and products not intended for human consumption» was developed. Now the document is sent to the Ministry of Justice for registration (resubmitted).
  10. A draft order of the Ministry of Agrarian Policy «On approval of rules for management of food products of animal origin intended for human consumption» was developed, an analysis of regulatory influence is being prepared for submission to the State Regulatory Service of Ukraine for approval.

The draft Law of Ukraine No 7186 as of 06.10.2017 is registered in the Parliament of Ukraine

At the meeting of the Committee on Agrarian Policy and Land Relations on November 20, 2018, MPs of Ukraine, members of the Committee reviewed the draft Law of Ukraine on State control of genetically modified products in agriculture and food industry (reg. No. 7186). The Committee recommended Verkhovna Rada of Ukraine to adopt it as a basis when finalizing certain provisions of the draft law No 7210 for the second reading.

DIRECTION: «STANDARDS OF KEEPING AND TREATMENT OF ANIMALS»

Done:

  1. On May 18, 2017, the Law of Ukraine «On State Control over observance of legislation on food, feed, animal by-products, animal health and welfare» (No. 2042-VIII), which was developed in accordance with EU Regulation No. 854/2004, No. 882, was adopted. / 2004, No. 669/2009, EU Directives No. 97/78/EU and Commission Decision 2006/778. The provisions of the Law are aimed at improving the legal framework of state control in ensuring safety and quality of food and feed, animal welfare     
  2. A draft order of the Ministry of Agrarian Policy «On approval of welfare requirements for the use of animals for agricultural purposes» was prepared.

DIRECTION «FOOD AND FEED SAFETY REQUIREMENTS»

Done:

  1. On May 18, 2017, the Law of Ukraine «On State Control over observance of the legislation on food, feed, animal by-products, animal health and welfare» (No. 2042-VIII), which was developed in accordance with EU Regulation No. 854/2004, No. 882, was adopted. / 2004, No. 669/2009, EU Directives No. 97/78/EU and Commission Decision 2006/778. The provisions of the Law are aimed at improving the legal framework of state control in ensuring the safety and quality of food and feed, animal welfare.
  2. The draft Law of Ukraine «On amendments to certain legislative acts of Ukraine on measures to increase traceability» was developed (No. 7489 dated January 16, 2018)

DIRECTION: BY-PRODUCTS OF ANIMAL ORIGIN

Done:

The Law of Ukraine «On amendments to the Law of Ukraine» On animal by-products not intended for human consumption» was adopted on September 20, 2016 in terms of harmonization of its provisions on treatment of products of animal origin of category II with the requirements of the EU legislation.

The draft order of the Ministry of Agrarian Policy «On Approval of veterinary and sanitary requirements for facilities (objects) for processing of by-products of animal origin» was developed; and is currently under consideration by the State Service of Ukraine for Food Safety and Consumer Protection after the agreement with the Ministry of Ecology and Natural Resources.

DIRECTION «FOOD PRODUCTS OF ANIMAL ORIGIN»

Done: 

The draft order of the Ministry of Agrarian Policy «On approval of special hygienic requirements to production and circulation of food products of animal origin» was developed.

DIRECTION: «HEALTH OF PLANTS»

The draft Law of Ukraine «On Plant Protection» was developed.

 DIRECTION: «GMO CONTROL – SEEDS AND SEEDLINGS OF PLANTS»

The draft Law of Ukraine «On amendments to certain Laws of Ukraine on tracking and labelling of genetically modified organisms and the treatment, tracking and labeling of food products, feed and/or feed additives, veterinary medicinal products obtained using genetically modified organisms» was approved by the Ministry of Finance of Ukraine, The Ministry of Health of Ukraine, the Ministry of Education and Science of Ukraine, the Ministry of Ecology and Natural Resources of Ukraine, the Ministry of Justice of Ukraine, the Ministry of Economic Development and Trade of Ukraine, the State Regulatory Service of Ukraine, State Service for Food Safety and Consumer Protection.

In October 2017, the draft law was approved at a meeting of the Cabinet of Ministers of Ukraine.

The draft law Reg. No 7210 as of 19.10.2017 is registered in the Verkhovna Rada of Ukraine.

Currently, the draft law is under consideration by the Committee of Agrarian Policy and Land Relations in Verhovna Rada of Ukraine.

At a meeting of the Committee on Agrarian Policy and Land Relations on November 20, 2018, MPs of Ukraine – members of the Committee reviewed the draft Law of Ukraine on amendments to certain laws of Ukraine on tracking and labeling of genetically modified organisms and circulation, tracking and labeling of food, feed and/or feed additives, veterinary drugs obtained using genetically modified organisms (Reg. No. 7210), submitted by the Cabinet of Ministers of Ukraine.

Following the discussion, the Committee decided to recommend to the Verkhovna Rada of Ukraine a draft Law of Ukraine on amendments to certain laws of Ukraine on tracking and labeling of genetically modified organisms and the circulation, tracking and labeling of food products, feed and/or feed additives, veterinary preparations obtained using genetically modified organisms (Reg. No. 7210to reject and include its norms into the draft law (Reg. No. 7186).

DIRECTION «REQUIREMENTS TO FOOD SAFETY»

A draft order of the Ministry of Agrarian Policy «On approval of special hygienic requirements during production and circulation of food products of animal origin» was developed.
